Article 1 - Definitions
In these General Terms and Conditions, the following definitions apply:
Lovely Corner's Grace Period: the duration during which the customer can exercise their right of withdrawal;
Customer: an individual who, without engaging in a professional or trade activity, enters into a distance contract with Yuanjia's Lovely Corner;
Day: refers to a calendar day;
Ongoing Agreement: a distance contract involving a series of products and/or services, with delivery and/or purchase obligations extending over an extended period;
Durable Medium: any means allowing the customer or business to store personally addressed information for future consultation and unchanged reproduction.
Right of Withdrawal: the customer's ability to withdraw from the distance contract within the grace period;
Yuanjia's Lovely Corner: refers to the natural or legal entity offering home furniture products and/or services to customers remotely;
Distance Contract: a contract where, within Yuanjia's organized system for distance sales of products and/or services, exclusively one or more distance communication methods are employed until the contract's conclusion;
Distance Communication Method: means employed for concluding a contract without the simultaneous physical presence of the Customer and Yuanjia's Lovely Corner.
General Terms and Conditions: pertains to the current General Terms and Conditions of Yuanjia's Lovely Corner.
Article 2 - Contact Information
Details regarding Yuanjia's Lovely Corner's contact information can be found on the website.
Article 3 - Applicability
These General Terms and Conditions are applicable to all offers presented by Yuanjia's Lovely Corner, as well as all distance contracts and orders entered into between Yuanjia's Lovely Corner and the Customer.
Prior to finalizing a distance contract, the Customer will be provided with these General Terms and Conditions' text. If this is not reasonably possible, it will be communicated that the General Terms and Conditions are accessible on Yuanjia's Lovely Corner's website and can be sent free of charge upon the Customer's request.
If the distance contract is concluded electronically, Yuanjia's Lovely Corner will make the General Terms and Conditions available to the customer electronically for storage on a durable medium. In case of additional product or service conditions alongside these General Terms and Conditions, the customer can rely on the most favorable provision in case of conflicts.
Any provision deemed invalid or destroyed in part or in whole will not affect the contract's validity. Yuanjia's Lovely Corner and the Customer will replace the void provision promptly with an alternative closely aligned with the original.
Matters not explicitly addressed in these General Terms and Conditions will be interpreted in alignment with the spirit of these General Terms and Conditions.
Article 4 - The Offer
If an offer is time-limited or subject to specific conditions, such details will be explicitly mentioned.
The offer is subject to change, and Yuanjia's Lovely Corner reserves the right to modify and adjust it accordingly.
The offer includes a comprehensive and accurate description of the products and/or services, detailed enough for the Customer to assess adequately. Images used are true representations, and obvious errors do not bind Yuanjia's Lovely Corner.
All images and technical data in the offer are indicative and cannot lead to compensation or contract dissolution.
Product images represent the actual products, but Yuanjia's Lovely Corner cannot guarantee precise color matching.
Each offer includes information specifying the customer's rights and obligations upon acceptance, including the price, shipping costs, contract conclusion method, withdrawal rights, payment method, and delivery details.
Optional information such as available sizes, colors, and materials may also be included.
Article 5 - The Contract
The contract is deemed concluded upon the Customer's acceptance of the offer and fulfillment of accompanying conditions.
Upon electronic acceptance, Yuanjia's Lovely Corner will promptly confirm receipt electronically. If confirmation is not received, the Customer may terminate the contract.
Electronic contracts are secured through technical and organizational measures ensuring data transmission security. Payment processes incorporate appropriate security measures.
Yuanjia's Lovely Corner reserves the right to investigate the Customer's ability to meet payment obligations and essential facts pertinent to responsible contract conclusion. If valid reasons exist to refuse a contract, Yuanjia's Lovely Corner may reject an order or impose special conditions.
With the product or service, Yuanjia's Lovely Corner will provide in writing or a storable medium accessible by the Customer:
- Yuanjia's Lovely Corner's contact address for complaints;
- Procedures for exercising the right of withdrawal or a clear statement of its exclusion;
- Information on guarantees and available after-sales services;
- Information from Article 4(3) of these General Terms and Conditions, unless previously communicated;
- Contract termination conditions for contracts lasting more than one year or indefinite.
If a continuous contract is involved, the above information applies only to the first delivery.
Each contract is contingent upon the necessary availability of the specified products.
Article 6 - Cooling-off Period
Customers can withdraw from a purchase within 14 days of product receipt without providing a reason. This period begins the day following product receipt.
During this period, the customer should handle the product and packaging with care, only using or unpacking to assess its suitability. If exercising the right of withdrawal, the customer must return the product with all supplied accessories in its original condition and packaging.
To initiate withdrawal, the customer must notify Yuanjia's Lovely Corner within 14 days of product receipt in writing or via email. The customer must return the product within 14 days, providing proof of shipment if necessary.
If, after the stipulated periods, the customer does not indicate withdrawal or return the product, the purchase becomes final.
Article 7 - Withdrawal Costs
Customers are responsible for the cost of returning products when exercising the right of withdrawal.
Upon valid withdrawal, Yuanjia's Lovely Corner will refund the amount paid by the customer within 14 days, contingent on product receipt or presentation of conclusive return proof.
Article 8 - Exclusion of the Right of Withdrawal
Yuanjia's Lovely Corner may exclude the right of withdrawal for specific products and services outlined in paragraphs 2 and 3. Exclusion is permissible only if clearly communicated in the offer before contract conclusion.
Exclusion is possible for products:
- Customized to customer specifications;
- Clearly personal in nature;
- Unsuited for return due to nature;
- Perishable or prone to aging;
- Subject to financial market fluctuations beyond Yuanj
Exclusion of the right of withdrawal is possible for services:
- Related to specific date or period activities like accommodation, transportation, restaurant services, or leisure activities;
- Whose delivery has commenced with the customer's express consent before the withdrawal period's expiration;
- Betting and lotteries.
Article 9 - The Price
Throughout the offer's validity period, prices for products and/or services will not increase, except for changes in VAT rates.
Yuanjia's Lovely Corner may indicate variable prices for products or services subject to financial market fluctuations. This dependence and indicative nature will be specified in the offer.
Price increases within 3 months post-contract are only permissible if legally mandated or justified. After 3 months, increases are allowable if communicated and customer termination is permitted.
As the delivery occurs outside the EU, VAT is not charged by Yuanjia's Lovely Corner. All prices are subject to printing and typographical errors, with no liability assumed for consequences. Yuanjia's Lovely Corner is not obligated to deliver products at an incorrect price due to printing or typographical errors.
Article 10 - Conformity and Warranty
Yuanjia's Lovely Corner guarantees products and/or services conform to the agreement, offer specifications, and relevant legal provisions. If agreed, the warranty extends to suitability for uses beyond normal.
Any warranty from the entrepreneur, manufacturer, or importer does not affect the consumer's statutory rights under the contract.
Defects or incorrect deliveries must be reported to Yuanjia's Lovely Corner in writing within 14 days of delivery. Products must be returned in original packaging and in new condition.
The warranty period aligns with the manufacturer's warranty. Yuanjia's Lovely Corner is not responsible for the product's ultimate suitability for individual applications or any advice on use.
Warranty is void if:
- The customer has personally or via third parties repaired or processed the products;
- The products have been mishandled or treated contrary to instructions;
- Defects arise from government regulations on material nature or quality.
Article 11 - Delivery and Execution
Yuanjia's Lovely Corner exercises the utmost care in receiving and fulfilling product orders.
Delivery takes place at the customer's provided address.
Orders will be executed promptly within 30 days, unless agreed upon otherwise. If delayed or partial execution is inevitable, the customer will be notified within 30 days. In such cases, the customer has the right to terminate the contract without charge and is entitled to compensation.
In cases of product unavailability, Yuanjia's Lovely Corner will strive to provide a suitable replacement. The customer will be clearly informed of this during delivery. The right of withdrawal remains unaffected in cases of replacement. Return costs are borne by Yuanjia's Lovely Corner.
Product risk is borne by Yuanjia's Lovely Corner until delivery to the customer or designated representative, unless expressly agreed otherwise.
Article 12 - Continuous Transactions: Duration, Termination, and Extension
Termination
Customers may terminate contracts for indefinite periods covering regular product or service supply, subject to agreed termination rules and a notice period not exceeding one month.
For definite contracts extending to regular product or service supply, customers may terminate at the specified term's end, subject to agreed termination rules and a notice period not exceeding one month.
Customers may terminate contracts:
- At any time with no fixed date or period restrictions;
- On the same terms they entered into the contract;
- With the same notice period set by Yuanjia's Lovely Corner.
Extension
Contracts for definite periods and regular product or service supply cannot be tacitly renewed or extended.
Exceptionally, contracts for definite periods and regular daily, news, and weekly newspaper and magazine supply may be tacitly extended for a maximum of three months. Customers can terminate this extended contract with one month's notice.
Contracts for definite periods and regular product or service supply may be tacitly extended for an indefinite term if customers can terminate at any time with one month's notice, or three months if the contract includes daily, news, and weekly newspaper or magazine delivery less than once a month.
Trial or taster subscription contracts automatically end at the trial or taster period's conclusion.
If a contract has a duration exceeding one year, the customer may terminate it at any time after one year with no more than one month's notice, unless fairness dictates otherwise.
Article 13 - Payment
Unless otherwise agreed, customer payments are due within 7 working days from the cooling-off period's start, as per Article 6(1). For service agreements, this period begins post-customer receipt of the contract confirmation.
Customers must immediately report any payment data inaccuracies to Yuanjia's Lovely Corner.
In case of non-payment, Yuanjia's Lovely Corner has the right to charge reasonable costs, communicated to the customer in advance, subject to legal constraints.
Article 14 - Complaints Procedure
Complaints regarding contract performance must be submitted within 7 days of defect discovery, with a full and clear description.
Yuanjia's Lovely Corner will respond to complaints within 14 days of receipt. If resolution requires more time, an acknowledgment of receipt and an expected response date will be provided within the 14-day period.
Unresolved complaints leading to disputes will be subject to dispute resolution procedures.
Complaints do not suspend Yuanjia's Lovely Corner's obligations unless expressly stated in writing.
If a complaint is valid, Yuanjia's Lovely Corner may replace or repair the products at its discretion, free of charge.
Article 15 - Disputes
Agreements between the Entrepreneur and the Consumer to which these General Terms and Conditions apply, law shall apply exclusively. Even if the consumer lives abroad.
